We will file your trademark with the UK Intellectual Property Office (UKIPO) and it will protect your reputation, goodwill and market position by prohibiting anyone else from trading under your brand’s name or one that is similar.

This also means that any legal procedure that would need to take place against infringement will be easier and much less expensive as an unregistered trademark has limited rights which can make it more difficult to enforce, should a problem arise.

Trademark law FAQs

A trademark is the strongest form of legal protection you can obtain for your company or brand in the UK. A trademark is literally a unique ‘mark’ for your company or brand that gives you the exclusive rights to trade under the company or brand name. A trademark distinguishes the goods and services from one seller to the next, and they are registered with the UK Intellectual Property Office under one of the 45 classes. 

There are 45 trademark classes- these separate goods and services from one another, so for example, Class 25 is for Clothing, Class 4 is for Candles. 

The classes are extremely broad and you can write your own item within the class. For example, you have a brand that sells eskimo coats for ice fishing in Iceland. Under Class 25, you can write ‘Eskimo Jackets’. You can also be broader in your selection, however the more specific, the better. 

The different classes also allow for companies to have the same name, trading in different areas of business. For example ‘Sky’ the TV network and ‘Sky’ a window cleaning company can happily coexist and trade under the same trademarked name, because they offer different services.

A trademark protects the name of your company or brand, the slogan, the logo and also things like scents. It gives you legal protection so that if someone uses your trademark, you can immediately take legal action against them with no need for proof. This differs from an unregistered trademark, whereby you would have to prove that someone is using your trademark without your permission. 

A trademark lasts for 10 years in the UK, at which point the trademark can be renewed. 

The fee for the application to UKIPO and for one class is £170, and then £50 for each additional class. 

You would speak with someone in the Legal Solutions Partnership who would be able to advise you which classes you will need to file your trademark under. Once this has been agreed with you, we would file your trademark for you with the UKIPO. There is then an official search report and examination period which takes between 2-3 weeks. There may or may not be a response to the examination period, if not, the trademark will be accepted and then published. There is an opposition period which enables anyone to oppose the publication of the trademark. If there is no opposition, registration can take place 5-6 months from the filing.
